CalPawAI Kullanım Koşulları

1. Taraflar ve kabul

CalPawAI uygulaması ("Uygulama") Murat Gözüdeli ("biz") tarafından geliştirilmekte ve sunulmaktadır. Uygulamayı indirerek veya kullanarak bu Kullanım Koşulları'nı ve Gizlilik Politikası'nı kabul etmiş olursunuz. İletişim: support.calpawai@gmail.com.

Uygulamayı App Store'dan edindiyseniz, Apple'ın Standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi (EULA) da geçerlidir. Bu Koşullar EULA'yı tamamlar; çelişki halinde EULA esas alınır.

2. Hizmetin niteliği ve sağlık uyarısı

CalPawAI, kalori/makro takibi ve genel beslenme alışkanlığı koçluğu sağlayan bir uygulamadır. CalPawAI tıbbi teşhis, tedavi veya profesyonel beslenme/diyetisyenlik hizmeti sunmaz. Uygulama içindeki "Paw" karakteri/koç bir doktor veya sağlık uzmanı değildir; sunduğu bilgiler tahminidir ve yalnızca genel bilgilendirme amaçlıdır. Herhangi bir sağlık durumu, kilo yönetimi veya beslenme kararı için lütfen bir doktora veya diyetisyene danışın. 18 yaş altı olarak işaretlenen profillerde kişiselleştirilmiş kilo verme/enerji açığı önerileri gösterilmez.

3. Hesap yok

Uygulama hesap oluşturmanızı veya giriş yapmanızı gerektirmez. Tüm verileriniz yalnızca cihazınızda saklanır (bkz. Gizlilik Politikası).

4. CalPawAI Pro abonelikleri

  • CalPawAI Pro, 3 aylık, 6 aylık ve 1 yıllık otomatik yenilenen abonelik olarak sunulur. Fiyat ve süre, satın alma öncesinde Uygulamada gösterilir.
  • Ödeme, satın alma onaylandığında Apple Kimliği (veya Google hesabı) üzerinden tahsil edilir.
  • Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmezse aynı süre ve gösterilen fiyattan otomatik olarak yenilenir; yenileme ücreti dönemin bitiminden önceki 24 saat içinde tahsil edilir.
  • Aboneliğinizi iPhone'da Ayarlar → [adınız] → Abonelikler bölümünden (Android'de Google Play > Abonelikler) yönetebilir ve iptal edebilirsiniz. İptal, mevcut dönemin sonunda geçerli olur. Uygulamayı silmek aboneliği iptal etmez.
  • Ücretsiz deneme sunulduğunda, deneme süresi sonunda iptal edilmeyen abonelik ücretlendirilir.
  • CalPawAI Pro Lifetime, Pro özelliklerini abonelik gerektirmeden açan tek seferlik bir satın alımdır. Satın aldığınız Lifetime'ı aynı Apple Kimliği/Google hesabıyla "Satın Alımları Geri Yükle" seçeneğini kullanarak yeni bir cihazda geri alabilirsiniz.

5. İadeler

App Store/Google Play üzerinden yapılan tüm ödemeler Apple/Google tarafından tahsil edilir ve iade talepleri ilgili mağazanın politikalarına göre değerlendirilir. Apple için reportaproblem.apple.com adresini kullanabilirsiniz. Yürürlükteki tüketici mevzuatından doğan haklarınız saklıdır.

6. Kabul edilebilir kullanım

Uygulamayı yasalara aykırı amaçlarla kullanmamayı; Uygulamayı veya hizmet sağlayıcılarımızın sistemlerini bozmaya, yetkisiz erişim sağlamaya, tersine mühendislik yapmaya veya satın alma sistemini atlatmaya çalışmamayı kabul edersiniz.

7. Fikri mülkiyet

Paw karakteri, görseller, sesler, metinler, tasarımlar ve yazılım dahil Uygulamadaki tüm içeriklerin hakları Murat Gözüdeli'ye veya lisans verenlerine aittir. Bu Koşullarda açıkça izin verilenler dışında hiçbir hak devredilmez.

8. Sorumluluğun sınırlandırılması

Uygulama "olduğu gibi" sunulur. Uygulamanın kesintisiz veya hatasız çalışacağını ya da Apple Sağlık/Health Connect gibi üçüncü taraf hizmetleriyle senkronizasyonun her zaman eksiksiz olacağını garanti etmeyiz. Uygulama tıbbi tavsiye yerine geçmez; sağlık kararlarınız için bir uzmana danışmalısınız. Yürürlükteki mevzuatın izin verdiği azami ölçüde, Uygulamanın kullanımından doğan dolaylı zararlardan sorumlu değiliz. Bu sınırlama, kasıt veya ağır ihmalden doğan sorumluluğu ve tüketici mevzuatından doğan vazgeçilemez haklarınızı etkilemez.

9. Fesih

Uygulamayı silerek istediğiniz zaman kullanımı sonlandırabilirsiniz. Veri silme seçenekleri Gizlilik Politikası'nda açıklanmıştır.

10. Uygulanacak hukuk

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Tüketici sıfatıyla bulunduğunuz ülkenin emredici tüketici koruma hükümlerinden doğan haklarınız saklıdır. Türkiye'deki tüketiciler, uyuşmazlıklarda yasal sınırlar dahilinde Tüketici Hakem Heyetlerine ve Tüketici Mahkemelerine başvurabilir.

11. Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Güncel sürüm bu sayfada yayımlanır ve yukarıdaki tarih güncellenir. Değişiklikten sonra Uygulamayı kullanmaya devam etmeniz güncel Koşulları kabul ettiğiniz anlamına gelir.

CalPawAI Terms of Use

1. Parties and acceptance

The CalPawAI app (the "App") is developed and provided by Murat Gözüdeli ("we"). By downloading or using the App you agree to these Terms of Use and the Privacy Policy. Contact: support.calpawai@gmail.com.

If you obtained the App from the App Store, Apple's Standard Licensed Application End User License Agreement (EULA) also applies. These Terms supplement the EULA; in case of conflict, the EULA controls.

2. Nature of the service and health disclaimer

CalPawAI provides calorie/macro tracking and general healthy-habit coaching. CalPawAI does not provide medical diagnosis, treatment, or professional nutrition/dietitian services. The in-app "Paw" coach character is not a doctor or health professional; the information it provides is estimated and for general informational purposes only. Consult a qualified healthcare professional for any health, weight-management, or nutrition decision. Profiles marked as under 18 never see personalized weight-loss/energy-deficit guidance.

3. No account

The App requires no account or sign-in. All your data is stored only on your device (see the Privacy Policy).

4. CalPawAI Pro subscriptions

  • CalPawAI Pro is offered as 3-month, 6-month and 1-year auto-renewing subscriptions. The price and length are shown in the App before purchase.
  • Payment is charged to your Apple ID (or Google account) when you confirm the purchase.
  • A subscription renews automatically for the same length and at the displayed price unless canceled at least 24 hours before the end of the current period; the renewal is charged within the 24 hours before the period ends.
  • You can manage and cancel your subscription in Settings → [your name] → Subscriptions on iPhone (Google Play > Subscriptions on Android). Cancellation takes effect at the end of the current period. Deleting the App does not cancel a subscription.
  • When a free trial is offered, the subscription is charged at the end of the trial unless canceled.
  • CalPawAI Pro Lifetime is a one-time purchase that unlocks Pro features without a subscription. You can get a Lifetime purchase back on a new device by using "Restore Purchases" with the same Apple ID/Google account.

5. Refunds

All App Store/Google Play payments are collected by Apple/Google, and refund requests are handled under that store's policies. For Apple, you can request a refund at reportaproblem.apple.com. Your rights under applicable consumer law are not affected.

6. Acceptable use

You agree not to use the App for unlawful purposes, and not to disrupt, gain unauthorized access to, reverse engineer, or circumvent the purchase system of the App or our service providers' systems.

7. Intellectual property

All content in the App, including the Paw character, images, sounds, text, designs and software, belongs to Murat Gözüdeli or its licensors. No rights are granted except as expressly stated in these Terms.

8. Limitation of liability

The App is provided "as is". We do not guarantee that the App will be uninterrupted or error-free, or that sync with Apple Health/Health Connect or other third-party services will always be complete. The App is not a substitute for medical advice; consult a professional for health decisions. To the maximum extent permitted by law, we are not liable for indirect damages arising from use of the App. This limitation does not affect liability for intent or gross negligence, or your non-waivable rights under consumer law.

9. Termination

You may stop using the App at any time by deleting it. Data deletion options are described in the Privacy Policy.

10. Governing law

These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer, you keep the protection of the mandatory consumer laws of your country of residence. Consumers in Türkiye may apply to Consumer Arbitration Committees and Consumer Courts within the legal limits.

11. Changes

We may update these Terms from time to time. The current version is published on this page with the date above updated. Continuing to use the App after a change means you accept the updated Terms.
